Rules on buying passenger air ticket through Internet.

The buyer of the ticket accepts that he knows these rules, which may be modified without previous notice, and therefore binds himself to periodically check the web-site to find out if these rules have been modified.

An air transport agreement is understood as the coming of minds whereby, in exchange for a price paid by the passenger, the airline provides the passenger the air transport service from one origin city to a destination city.

Air tickets have certain restrictions, the main one is that they cannot be transferred; therefore, the passenger must check that his name has been written correctly in the ticket. Another restriction is that the rates of tickets are not refundable.

Further restrictions shall be notified upon buying the ticket.

The passenger has the right to be transported, the right to carry luggage with him, which is understood as a suitcase containing clothing and toiletry items. He is also entitled to carry a small case with valuables and keep it near him inside the passenger cabin.

The passenger is obliged to pay for the cost of the ticket and observe the corresponding regulations of the respective laws, as well as the airline's policies and terms.

The passenger will be informed of the main rules through this document.

 

Fuel concept surcharge.

Domestic flights:

       - This surcharges are added to fare and could be of up to $700.00 MXN + VAT.

International flights:

       - They will apply a surcharge, added to fare, of $55.00 USD + VAT.
      
Surcharges generate Value Added Tax (VAT) per segment and per passenger.

Passengers with special requirements.

Those people who require an extra seat for their comfort, will have to ask for it at the time of their reservation or when buying their ticket, so that, they can check the applicable fares.


Documents.

The passenger must be at the airport ticket counter 120 minutes before departure for international flights, and 90 minutes for domestic flights.

Passengers on international flights must have their passport and the US visa with them in order to fly to a city in the United States. If necessary, they must also carry evidence of or a vaccination certificate, for countries where required.

Failure to comply with these requirements releases the airline from any responsibility.

Luggage.

 

On domestic flights the passenger may carry as much as 25 kilograms ( 55 pounds ). International flights are subject to the per piece of luggage system, permitting 2 pieces of luggage, with the largest not exceeding 1.58 meters ( 62 inches ), and the warning that both suitcases altogether must not exceed 2.73 meters ( 107 inches ), and each must not weigh more than 23 kilograms ( 50 pounds ).

A passenger carrying more luggage than permitted must pay for excess luggage. It will apply a charge of $ 100.00 MXN ( + VAT ) for each extra kilo. In all cases, excess luggage shall be transported based on availability of space on the aircraft.

The time before the flight a passenger must be at the ticket counter to check in may vary, of which the passenger will be notified before buying his ticket.

Luggage identification:

All luggage must be identified on the outside and inside with the passenger's name and address. Identification labels are available free at any AVIACSA ticket counter.

Items permitted in checked-in luggage: CLOTHING AND TOILETRY ITEMS.

Items that MUST NOT BE CARRIED in checked-in luggage: Money, jewelry, securities, electronic items such as radios, cell phones, lap-tops, among others, medication, perishable items, liquids. There is also the prohibition to carry any kind of firearms, gas, flammable substances, and lighters, among others. We do not recommend carrying fragile items.

AVIACSA is not responsible for loss of the above-mentioned items that are not considered luggage and are transported without the airline's knowledge or consent.

If for any reason a suitcase does not arrive at the band where luggage from the corresponding flight will be delivered, before leaving the secluded passenger area passengers must present their claim with the airline's personnel in charge of luggage, as otherwise their claim will have no effect. The same procedure applies to damaged suitcases.

Compensation for luggage lost on domestic flights shall be paid as established in the Civil Aviation Law, which provides that the amount of 75 days of the minimum salary in effect in the Federal District shall be paid. The provisions of the Montreal Agreement shall apply for international flights.

Delayed Luggage

In cases when a passenger arrives at a destination other than his place of residence and the luggage does not arrive with him, by request from the passenger, for every day passed without receiving the suitcase, the passenger will receive $250.00*MXN per day for a maximum of three days, that is, he will receive a maximum of $750.00*MXN in case of domestic flights. For international flights the passenger will receive US $25.00* per day and a maximum of US $75.00*, to cover purchases of the necessary clothing and toiletry items.

According to the Civil Aviation Law rates are freely established by airline companies and need only be registered with the Department of Communications and Transport in order to be effective. The applicable restrictions must be clearly specified, which the user must be informed of when the service is provided. *

* Consequently every time a passenger buys a ticket at a determined rate on the Internet, the web page must inform him of the restriction applicable to the rate he is obtaining and evidently, the valid term of the ticket.

Prices may vary according to agencies or promotions.

Oversold flights.

According to the Law, in case of oversold flights that dot not allow passengers to board their flight, as opted by the passenger, the airline must:

I. Refund the price of the passenger ticket or the unused portion of the ticket.

II. By all means within its reach, offer substitute transportation on the first available flight and at least freely provide the passenger telephone and cable communication service to his point of destination; food according to the time he must wait to catch another flight; lodging in an hotel of the airport or city where he must spend the night and, in the latter case, land transportation from and to the airport, or

III. On a later date suitable for the passenger, transport him to his point of destination as originally planned.

In cases of items I and III above, the airline must also pay the affected passenger a compensation not below 25% of the passenger ticket price or the unused portion of the ticket.

Cancelled flights.

According to the Law, the airline, without previous warning, can cancell either a flight or a booking with the only obligation to refund the total amount paid for the tickets not used.

 

Controversy.

The passenger accept to submit under Mexico's City courts and laws, waiving any other forum that might correspond to himself by reason of his present or future place of residence.
